PAN Registration

PAN card or the permanent account number is a 10-digit identity number issued by the Indian income tax authority under S 139A of the Indian Income Tax Act 1961. The benfits of a PAN card is that it keeps track of taxes payments to avoid fraud and evasion, as the PAN number is mandatory while filling out any tax filing or return forms. An Indian resident can apply for PAN irrespective of citizenship. A PAN is required to file taxes or make payments above the amount of Rs. 50,000.

A PAN card can be issued to any of the categories mentioned:

  • Association of persons (AOP)
  • Body of individuals (BOI)
  • Company
  • LLP (limited liability partnership)
  • Firm/ Business
  • Government
  • HUF [Hindu joint family|Hindu undivided family]
  • Local authority
  • Artificial juridical person
  • Individual or Person
  • Trust (AOP)

Registration Procdure

PAN can be applied in two ways- physically or online. It can be applied for psychically by submitting an application (Form 49A/49AA) with the requisite documents at the authorised agency in one’s town or city. Or, it can be applied for online on the website http://incometaxindiaefiling.gov.in./ along with the requisite documents.

ePAN:

One can apply for the ePAN online on the website mentioned above. But the ePAN isn’t available to the same categories of people as the people and entities coming under S.160 of Indian Income Tax Act 1961 are barred from applying for the ePAN as aadhar is a pre-requisite for it, so only a person who hold the aadhar card can apply it so entities like HUF, LLP, Companies are barred from applying for it.

Documents Required

The following documents will be required for a PAN card application:

  1.  Identity proof documents (Elector’s photo identity card, Passport, Driving licence)
  • Address proof document (copy of the following documents of not more than three months old – electricity bill, landline telephone or broadband connection bill, water bill)
  • Proof of date of birth (birth certificate issued by the Municipal Authority, pension payment order, matriculation certificate, passport)

HUF : (a) An affidavit by the karta of the Hindu Undivided Family stating the name, father’s name and address of all the coparceners on the date of application; and

(b) copy of any document applicable in the case of an individual specified in serial number 1, in respect of karta of the Hindu undivided family, as proof of identity, address and date of birth.

Company : Copy of Certificate of Registration issued by the Registrar of Companies.

Firm/LLP:  (a) Copy of Certificate of Registration issued by the Registrar of Firms/Limited Liability Partnerships; or

(b) copy of Partnership Deed.

Association of persons (Trusts) formed or registered in India : (a) Copy of trust deed; or

(b) copy of Certificate of Registration Number issued by Charity Commissioner.

Individuals not being a citizen of India :

(i) Proof of identity :— (a) copy of Passport; or

(b) copy of person of Indian Origin card issued by the Government of India; or

(c) copy of Overseas Citizenship of India Card issued by Government of India; or

(d) copy of other national or citizenship Identification Number or Taxpayer Identification Number duly attested by “Apostille” (in respect of countries which are signatories to the Hague Apostille Convention of 1961) or by Indian embassy or High Commission or Consulate in the country where the applicant is located or authorised officials of overseas branches of Scheduled Banks registered in India.

(ii) Proof of address:— (a) copy of Passport; or

(b) copy of person of Indian Origin card issued by the Government of India; or

(c) copy of Overseas Citizenship of India Card issued by Government of India; or

(d) copy of the registration certificate issued by the Foreigner’s Registration Office showing Indian address; or

(e) copy of Visa granted and copy of appointment letter or contract from Indian Company and Certificate (in original) of Indian Address issued by the employer.

Choose “PAN – New/Change Request” in the Application Type section and fill the 15 digit acknowledgement number.

  • How to link PAN card with Aadhaar card?

It can be sent by sending an SMS to 567678/56161 sending the following-  UIDPAN<12-digit Aadhaar><10-digit PAN> and send it.

  • What is the penalty for not obtaining PAN card?

According to S. 272B of the Income Tax Act 1961, a penalty of ₹10,000  can be imposed if anyone is found to have given an incorrect PAN number.
